To ensure your notarization goes smoothly and without delays, please review the checklist below before your scheduled appointment.
⚠️ Please note: Notaries are not allowed to choose your document type, explain legal effects, or tell you how to complete a document. If your document is incomplete, unsigned by witnesses, or proper ID is unavailable, the notarization may be refused.
If a signer does not have acceptable identification and is not personally known to the notary, Texas law requires the use of credible witnesses.
A credible witness must personally know the signer and swear or affirm to the signer’s identity. Each credible witness must also present valid, government-issued photo identification.
Texas requires two (2) credible witnesses when the signer is unknown to the notary.
In Texas, a notary public acts as an impartial witness appointed by the Secretary of State to prevent fraud in legal and personal transactions, with main duties including verifying signers' identities via ID or personal knowledge, confirming voluntary and competent signing, and applying an official seal or signature. Common notarial acts encompass acknowledgments for documents like deeds, powers of attorney, or affidavits; administering oaths for sworn statements or testimonies; and performing permitted copy certifications where allowed by Texas law, though not official public documents and are prohibited from drafting documents or giving legal advice.
